CEO of NetNaija Faces Charges of Copyright Infringement, Detained in Kuje

Emmanuel Analike, the Chief Executive Officer of NetNaija, has appeared in court at the Federal High Court in Abuja to face charges related to copyright infringement, and he is now being held at Kuje Correctional Centre while he awaits a decision on his bail request.

Mr. Analike set up Netnaija Media Enterprises in 2019, operating as a sole proprietor focused on internet services. The NetNaija platform has emerged as one of Nigeria's leading entertainment websites, providing a wide selection of films, music, and video downloads to numerous users.

On Wednesday, Mr. Analike appeared before Justice Suleiman Liman, following legal action taken by the Nigerian Copyright Commission (NCC). The commission has accused him of unlawfully possessing, reproducing, and distributing pirated content, including films and music, on the NetNaija platform.

These allegations come under the purview of Nigeria's recently amended copyright law, introduced through the Copyright Act 2022, which has broadened the definition of offenses and heightened penalties for breaches of intellectual property rights.

During the court proceedings, Mr. Analike pleaded not guilty to all charges. His attorney requested bail; however, Justice Liman opted not to provide an immediate ruling. Instead, the judge ordered his continued detention while deliberations on the bail application proceed. The next hearing for the bail ruling is scheduled for March 9.

This case marks a significant enforcement move by the NCC against online piracy in Nigeria. For several years, NetNaija has been a prominent platform for entertainment downloads, attracting millions of visitors each month. Despite its popularity, the site has faced criticism from film and music professionals who argue that it undermines legal distribution methods.

NCC officials assert that this prosecution indicates a new approach towards holding platform operators responsible for piracy rather than focusing enforcement efforts solely on individual users who access pirated content.

The arraignment of Mr. Analike occurs amidst increasing unrest within Nigeria's creative sectors concerning violations of intellectual property rights. Just last year, notable Nollywood figures, such as Omoni Oboli and Bimbo Ademoye, publicly accused some Ghanaian broadcasting stations of airing their films without permission, reigniting discussions on the enforcement of copyright laws across West Africa.

Additionally, various disputes have arisen in recent years regarding script ownership and copyright claims within the industry, involving cases of Nollywood films being distributed online without authorization and allegations of copied scripts.
