A 37-year-old man has been sentenced to 25 years in direct imprisonment by the Boschfontein Regional Court located in Mpumalanga, South Africa, after being found guilty of raping a four-year-old girl.
The National Prosecuting Authority (NPA) released a statement on Monday, March 2, 2026, indicating that the identity of the accused has been kept confidential to shield the victim from any further trauma.
At the time of the crime, the man was working as a general laborer at the creche that the young girl attended.
The incident happened on September 1, 2023, within the creche's premises after school hours.
The young girl was playing outside with her friends, as they resided nearby.
The accused lured the girl into the kitchen of the creche, locked the door, and raped her.
The child's sister, who was also playing outside, peeked through a window and witnessed the horrific act.
Later that same day, the victim confided in her mother about experiencing pain in her genital area.
Upon further investigation, the mother learned from the sister what she had observed.
The incident was promptly reported to the police, resulting in the immediate arrest of the suspect.
During court proceedings, the accused denied the charges, asserting that he was not present at the creche when the incident took place.
However, Regional Prosecutor Thembile Ngonyama successfully presented strong evidence, including testimony from various witnesses, the initial statement from the victim, a medical report known as J88, and the eyewitness account provided by the victim's sister.
The court deemed the State’s witnesses credible and dismissed the defendant's claims.
Prosecutor Ngonyama emphasized the alarming rate of such offenses, arguing against lenience and advocating for adherence to the minimum sentence prescribed by law.
A Victim Impact Statement was produced by the victim's mother, with the help of Court Preparation Officer Lizzy Mhlongo, illustrating the severe psychological and physical trauma inflicted on the child and her family.
The court concluded there were no significant or compelling reasons to justify a deviation from the minimum sentence.
Consequently, the accused received a sentence of 25 years for the rape charge.
In addition, the court issued orders to list his name in the National Register for Sex Offenders, declared him unfit for working with children, and also ruled him unsuitable to possess a firearm.
The NPA expressed satisfaction with the sentence, reaffirming its commitment to achieving justice for victims of gender-based violence (GBV), especially for vulnerable children.
“This ruling sends a powerful message that acts of sexual violence against children will face stringent legal repercussions. The NPA remains focused on fostering safer communities through thorough prosecutions and support for victims,” the statement concluded.
