A court in Rivers State has indefinitely postponed the hearing of the impeachment challenge filed by Governor Siminalayi Fubara and his Deputy, Professor Ngozi Nma-Ordu, pending appeals.
Justice Florence Fiberesima presided over the case at the Oyigbo High Court in Port Harcourt, where she granted the adjournment after a request from the plaintiffs’s legal team. The challenge arose from the impeachment proceedings initiated by Speaker Martin Amaewhule, along with 26 other members of the Rivers State House of Assembly, and the House Clerk.
During the court session, S.I Amen, the lead attorney for Speaker Amaewhule and the additional 27 assembly members, informed the judge of the appeal that had been filed. He made an oral request for the court to delay further hearings until the appeal was resolved.
This request was not contested by the lead counsel for the claimants, Paul Orikoro, a Senior Advocate of Nigeria, nor by Lawrence Oko-Jaja, who represents the defendants.
In her ruling, Justice Fiberesima decided to adjourn the case sine die to allow the appeal court to examine the matter before it.
Previously, this same court had issued an interim injunction against Speaker Amaewhule, 32 other members of the assembly, and the Clerk of the House, which barred them from submitting impeachment documents to the Chief Judge of Rivers State. The injunction specifically prevented the Chief Judge, Justice Simeon Chibuzor-Amadi, from acting on any communication or request pertaining to the setup of a panel to investigate alleged gross misconduct for a period of seven days.
