Jimmy Lai, a prominent media figure in Hong Kong, received a 20-year jail term on Monday following his conviction on several national security charges, marking the conclusion of the most high-profile national security trial in the region.

Lai was convicted of two counts of collusion with foreign entities and one count related to the publication of seditious materials. The trial extended over a span of nearly five years and represents a significant prosecution under the national security laws enacted by Beijing.

The founder of the now-defunct Apple Daily newspaper was initially apprehended in August 2020 and found guilty last year. The sentence he received is classified within the most severe bracket, ranging from 10 years to life imprisonment for offenses considered gravely serious, establishing it as the most stringent punishment executed to date under this legislation.

The judges overseeing the national security case noted that Lai’s role as the “mastermind” and pivotal instigator of the allegations of continuous conspiracies to engage with foreign forces warranted the heightened sentence.

They referenced prosecutorial evidence which pointed towards these conspiracies aiming to garner sanctions, blockades, and other adversarial actions from the United States and various nations, implicating a network involving Apple Daily employees, activists, and foreign participants.

The judges articulated, “In this particular situation, it is clear that Lai orchestrated all three conspiracies under scrutiny, thereby necessitating a more substantial sentence.” They added, “It is challenging to differentiate the culpability of the remaining parties.”

Alongside Lai, six former high-ranking employees of Apple Daily, an activist, and a paralegal received prison sentences that varied from six to ten years.

The 78-year-old, who possesses British nationality, maintains his innocence, asserting to the court that he is a “political prisoner” subjected to persecution by the Chinese government.

His situation has attracted extensive international condemnation, including reactions from US President Donald Trump and British Prime Minister Keir Starmer, and underscores the ongoing crackdown on national security in Hong Kong that has transpired since the pro-democracy protests in 2019.

Concerns stem significantly from Lai’s global visibility as a vocal opponent of the Chinese Communist Party as well as his connections within political circles in the US. Prosecutors highlighted these affiliations during the trial proceedings.

Amidst the peak of the protests in July 2019, Lai had meetings with US figures, including then-Vice President Mike Pence and then-Secretary of State Mike Pompeo in Washington.

Jodie Ginsberg, CEO of the Committee to Protect Journalists, remarked, “The rule of law in Hong Kong has been thoroughly dismantled. Today’s unjust ruling is the ultimate blow to press freedom in the region.” She urged the international community to intensify efforts to demand Lai’s release if freedom of the press is to hold value anywhere globally.

As he arrived at the court, Lai was seen wearing a white jacket, clasping his hands in prayer while smiling and acknowledging his supporters.

Advocacy groups and supporters have intensified their calls for his release, particularly highlighting health concerns associated with his imprisonment.

Elaine Pearson, the Asia director for Human Rights Watch stated, “The severe 20-year sentence imposed on 78-year-old Jimmy Lai equates to an effective death sentence. Such a disproportionate sentence is both inhumane and deeply unjust.”

Beijing and Hong Kong officials have affirmed that Lai underwent a fair trial and argue that the national security law was crucial in reinstating order within the city.

Numerous supporters queued for several days in an effort to attend court proceedings, amidst significant security measures that included police presence, sniffer dogs, and armored vehicles.

“I believe Mr. Lai embodies the conscience of Hong Kong,” expressed a 64-year- old supporter named Sum, who waited to enter the courtroom. “He advocates for the people of Hong Kong, highlights wrongful cases in mainland China, and promotes democracy. I consider sacrificing a few days of my own freedom to ensure he isn’t confined is worthwhile.”

Starmer brought up Lai’s situation in discussions with Chinese President Xi Jinping during a meeting in Beijing last month, as did Trump in an October encounter.

Several diplomats from Western nations have suggested that discussions regarding Lai’s release are likely to gain momentum following the sentencing.

Lai’s attorney, Robert Pang, mentioned that he could not confirm whether his client would seek to appeal the ruling but noted that Lai has 28 days to make such a decision.

The judges expressed reluctance to moderate Lai’s sentence based on his age, health status, or time spent in isolation, although they acknowledged that he would experience a “more challenging” incarceration compared to other prisoners. They reduced the sedition sentence by one month and reduced one year from each collusion charge.
